Acceptance of terms
By accessing or using SortmyMeal, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the platform. We may update these terms from time to time; continued use after changes constitutes acceptance.
Use of the platform
You must use the platform lawfully and in good faith. You are responsible for the accuracy of your profile and listings. You must not misuse the service, harass others, or violate any applicable laws. We reserve the right to suspend or terminate accounts that breach these terms.
Terms for users (customers)
If you use SortmyMeal to find, order, or receive food from vendors:
- Orders and enquiries: Enquiries and orders are agreements between you and the vendor. SortmyMeal does not guarantee availability, acceptance, or fulfilment of any order. Vendors may decline, modify, or cancel orders at their discretion.
- Payment and pricing: All payments are made directly to the vendor unless otherwise stated. Prices, delivery fees, and payment methods are set by the vendor. We are not responsible for incorrect pricing, failed payments, refunds, or currency issues.
- Delivery and collection: Delivery times, areas, and methods are determined by the vendor. We are not responsible for late, missing, or incorrect deliveries, or for any loss or damage during delivery or collection.
- Allergies and dietary requirements: You are responsible for informing the vendor of any allergies or dietary needs. We do not verify allergen or ingredient information provided by vendors. Consuming food from the platform is at your own risk.
- Disputes and complaints: Any dispute about quality, quantity, payment, or delivery is between you and the vendor. SortmyMeal may facilitate contact but has no obligation to resolve or compensate. We are not liable for any resolution or outcome.
- Conduct: You must not abuse vendors, leave false reviews, or use the platform for fraud. We may remove reviews or suspend accounts that breach these terms.
Terms for vendors (sellers)
If you list or sell food or food-related services on SortmyMeal:
- Eligibility and compliance: You must comply with all applicable laws, including food safety, hygiene, labelling, licensing, and tax regulations in your jurisdiction. You are solely responsible for obtaining any required permits, registrations, or approvals. SortmyMeal does not verify your compliance and is not liable if you operate without required authorisations.
- Listings and content: You are responsible for the accuracy, legality, and completeness of your listings, including descriptions, images, prices, allergens, and ingredients. False or misleading information may result in removal of listings and suspension of your account. You must not list prohibited items or violate intellectual property rights.
- Food safety and hygiene: You are solely responsible for the safety, storage, preparation, and handling of all food you supply. This includes allergen control, expiry dates, and cross-contamination. Any illness, injury, or allergic reaction arising from your food is your responsibility. We disclaim all liability in this regard.
- Orders and fulfilment: You decide whether to accept, decline, or modify orders. Once accepted, you are responsible for fulfilling orders as described and in a timely manner. Cancellations, delays, or substitutions may affect your reputation and we are not liable for any consequences.
- Payment and taxes: You are responsible for collecting payment from customers, handling refunds, and complying with tax obligations. SortmyMeal does not process payments on your behalf unless explicitly stated. We are not liable for non-payment, chargebacks, or tax issues.
- Delivery and liability: If you deliver, you are responsible for delivery conditions, timing, and any loss or damage in transit. You must maintain appropriate insurance if required by law. We are not liable for delivery-related claims.
- Account suspension and termination: We may suspend or terminate your account and remove your listings without notice if we believe you have breached these terms, violated the law, or posed a risk to users or the platform. We have no obligation to reinstate accounts or compensate for lost business.
- UK vendors: If you operate in the United Kingdom, you must register as a food business with your local authority at least 28 days before trading (see gov.uk/food-business-registration). You must provide accurate allergen information for all menu items (the 14 allergens required under UK law). You are responsible for registering as self-employed with HMRC and for all tax and food safety compliance. We do not verify your registration or compliance.
Transactions between users
SortmyMeal facilitates connections between users and food providers. We do not take part in, guarantee, or mediate individual transactions. Any agreement, payment, or dispute is between you and the other party. We are not liable for any loss, damage, or dispute arising from those transactions.
Marketplace and food safety disclaimer
SortmyMeal is a marketplace platform only. We are not a food manufacturer, preparer, or seller. We are not responsible for the safety, quality, hygiene, labelling, or legality of any food prepared or supplied by vendors. Food safety, allergen information, and compliance with local food laws are the sole responsibility of the vendors. Users assume all risk related to consuming food obtained through the platform. We disclaim all liability to the fullest extent permitted by law in respect of any illness, injury, or loss arising from food or from your use of the marketplace.
Content and intellectual property
You retain ownership of content you submit (e.g. listings, photos, reviews). By submitting content, you grant us a non-exclusive licence to use, display, and distribute it in connection with the platform. You must not upload content that infringes others' rights or violates law. We may remove content and suspend accounts for infringement or inappropriate material. We are not liable for content posted by users.
Limitation of liability
To the fullest extent permitted by law, SortmyMeal and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the platform or any transaction with another user. Our total liability for any claim relating to the platform shall not exceed the amount you paid to SortmyMeal (if any) in the twelve months before the claim. Nothing in these terms excludes or limits liability that cannot be excluded or limited by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless SortmyMeal and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the platform; (b) your breach of these terms; (c) your violation of any law or third-party rights; (d) any content you submit; or (e) any transaction, dispute, or food-related incident between you and another user.
General
These terms are governed by the laws of the jurisdiction in which SortmyMeal operates. If any provision is held invalid, the remainder remains in effect. Our failure to enforce any right does not waive that right. We may assign our rights and obligations; you may not assign without our consent. These terms, together with the Privacy Policy and any other policies we publish, constitute the entire agreement between you and SortmyMeal regarding the platform.
